Coaching Terms and Conditions

 

 

The Terms and Conditions & Policies outlined below define the relationship between me as the coach and you as the client and govern any services I deliver. Please make sure you read the following carefully. If you have any questions, please contact me at john@pivotcoaching.co.uk

 

  1. Coaching is a two-way process between the Coach and the Client. It is thought-provoking and creative, inspiring you to maximize your personal and professional potential. It is collaborative, but most of the work is done by you, for you. My role is to ask questions, gain insights, motivate you, and help you plan a successful route to meet your goals. It is not to do the hard work of getting there.

  2. I agree to maintain a recognized Code of Ethics and standards of behaviour set out by the Association for Coaching or other bodies occasionally.

  3. You are responsible for creating and implementing your physical, mental, and emotional well-being, decisions, choices, actions, and results. Therefore, you accept that I am not liable for any actions, inactions, or direct or indirect results of any services I provide.

  4. If you are currently under the care of a mental health professional, I recommend that you first inform your care provider. They may provide a referral letter or advise you not to proceed.

  5. You agree to communicate honestly, be open to feedback, and create the time and energy to be successful and participate fully.

  6. We will agree on a schedule of contact and assistance, and any individual add-on sessions can be booked up to 3 months in advance and altered up to 48 hours in advance.

  7. If you have booked a session and do not turn up or provide 48 hours notice of a change, you will be billed for a missed session. I will wait 15 minutes on the day before considering the session cancelled.

  8. If you are unhappy with any of the terms and conditions, you can contact me to discuss and resolve your concerns. Payment of the fee constitutes acceptance of these terms and conditions.

  9. The schedule (including the number and frequency of sessions) and the fees due for coaching sessions will be agreed upon at the start of our agreement and confirmed by me by email or text. Where we do not agree on a specific number of sessions, I will provide sessions on a one-by-one basis.

  10. The start date of the service will be on our first contact after payment.

  11. In return for payment directly by you or a third party, I agree to provide the service described in this agreement and per the terms and conditions set out in this agreement. You (or a third party on your behalf) agree to pay fees for the service on the terms and conditions set out in this agreement.

  12. Before beginning our agreement, we will agree on the protocols for contact, timings and media to use – for example, FaceTime® or WhatsApp®, including any protocols for contacting each other between designated sessions or other delivery of services.

  13. I may assign you tasks or exercises to complete between coaching sessions. While you are not obligated to do these, you accept that not doing them will slow your progress.

  14. According to the Association for Coaching's Code of Ethics, our coaching relationship is bound by confidentiality but is not considered a legally privileged confidential relationship. This includes all information (documented or verbal) shared within it. 

  15. I agree not to disclose any information relating to you without your written consent. I will not disclose your name as a reference without your permission. Confidential information does not include information that:

    • Was in my possession before our relationship;

    • Is generally known to the public or in your industry;

    • Is obtained by me from a third party without breach of any obligation to you or

    • The law requires me to disclose.

  16. According to our profession's ethics, topics may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, and further coaching professional development and/or consultation purposes.

  17. You must pay your fees online via an electronic invoicing system or direct bank transfer. If your employer requests receipts, they will be emailed unless otherwise requested.

  18. Fees are payable in advance at the time of booking, and unless otherwise agreed, a booking is confirmed only upon receipt of payment in full. Where payment has not been received in advance of a coaching session, I am not obliged to provide the session.

  19. Where payment is required on receipt of invoice rather than in advance, payment terms will be agreed in advance, and a charge may be levied for late payment.

  20. Where a client pays for a session or sessions in advance, they must have the coaching session(s) paid for within 12 months of the payment, or the sessions will be deemed forfeit.

  21. Either party may terminate this agreement at any time with two weeks' written notice. Once a contract is terminated, other than as required by law (such as tax law), I will remove your details from my systems within one month.

  22. If I change any of these terms or conditions, I will provide a minimum of 30 days' notice. If, following receipt of such notification, you no longer wish to proceed with further coaching sessions, you may withdraw from the service immediately by giving notice in writing by email or letter. You may be entitled to a pro-rata refund of any fees paid in advance for coaching sessions not yet provided. Such notice will be effective on receipt by me.

  23. This contract is governed by the law of England, whose courts have exclusive jurisdiction concerning any dispute, disagreement, proceedings or legal claim of any nature relating to the service provided or the contract.

  24. Except as expressly provided in this agreement, I make no guarantees or warranties, express or implied. I will not be liable to you or others for consequential or special damages. Notwithstanding any damages you may incur, my entire liability under this agreement and your exclusive remedy will be limited to the amount paid by you to me under this agreement for all services rendered up until the termination date.

  25. This is the parties' entire agreement and reflects a complete understanding of the parties concerning the subject matter. This agreement supersedes all prior written and oral representations.

  26. Pivot Coaching is a sole trader business owned by Kristen Davidson.

 

 

Disclaimer

  1. You understand that the coaching services you will receive from me are not offered as a substitute for professional nutritional, mental health or medical care and do not diagnose, treat or cure any mental health or medical conditions. Coaching is not therapy and will not cure any underlying mental illnesses.

  2. You also understand that I am not acting as a mental health counsellor or a medical professional.

  3. You understand that coaching is not currently a regulated industry and that despite having a diploma, I am not licensed by any UK body.

  4. You understand and agree that you are fully responsible for your well-being during coaching and afterwards.

  5. You understand that coaching is not a substitute for professional dietician support, counselling, psychotherapy, psychoanalysis, or medical care. Where appropriate, I will stop working with you and refer you to those services.

  6. You understand that all comments and ideas I offer are solely to provide a pathway to achieving your goals.Reaching those goals is your responsibility.

  7. You give your informed consent to me to assist you in achieving such goals and understand that results are not guaranteed, particularly over a short period.

  8. You understand that I will protect and treat your information as confidential unless I state otherwise in writing. If I report abusive situations, safeguarding issues to children or vulnerable adults or threats to harm yourself or others, you understand that I must ethically report this and use confidential information in the process of dealing with the issue.
